Larissa: Three-year prison sentence to two people for possession of pornographic material depicting a minor schoolmate

Two young people – a man and a woman – were sentenced to three years in custody, with a three-year suspension, today by the Joint Jury Court Larissa for possession of pornographic material.

As the larissanet.gr website reports, the video depicted their male classmate with the act taking place at a school in Volos in the spring of 2023.

The two men were originally on trial for revenge porn and sexual abuse of a minor

The indictment, however, on which the two men, who are adults, were originally indicted, was more serious, with charges including “abuse of a person incapable of resisting a sexual act” and “revenge pornography of a minor.”

Specifically, the charge was that the young man performed a sexual act with the minor at school while recording the act on his cellphone while the second defendant then showed the images to a classmate with vindictive intent for her classmate.

The defendants and the victim denied that a sexual act was committed

The defendants in their plea denied committing a sexual act with the accused stating that there were only two photos in which the minor was depicted in her underwear, while the accused testified that she took the photos from the former’s cell phone and showed them to a classmate, noting, however, that she did not want to retaliate against anyone.

Earlier, the victim also testified, and denied that a sexual act was committed.

The prosecutor even described her testimony as a “pillar of the evidentiary challenge to the material,” adding that it was supported by the testimony of her parents who also testified that no sexual act was committed.

The prosecutor in his summation said the evidence collected in the pre-trial and which was examined by the court today it is “critically incomplete because it presents many loose ends” adding that because of this, the court cannot reach a safe verdict as to the guilt of the accused.

Convicted of child pornography and possession of pornographic material

Regarding the charges of possession of pornographic material and trafficking in child pornography material, he stressed that these were not committed with the criteria and character defined by the relevant article of the Criminal Code, suggesting that the defendants be acquitted for these acts as well.

The court ultimately convicted the defendants only for the possession of pornographic material and, after recognizing a mitigating circumstance, imposed a sentence of three years’ imprisonment suspended for three years, with the appeal having a suspensive effect.
