New building regulation provisions unconstitutional, Supreme Court rules 

Greece's supreme administrative court, the Council of State, has ruled that key provisions of the New Building Regulation (NOK) are unconstitutional.

These provisions include incentives to increase building height in exchange for enhanced energy efficiency and more communal and green spaces, which, the court ruled, violate Article 24, paragraphs 1 and 2 of the Constitution.

Building permits for projects already in progress will not be impacted by the court decision. 

The decision concerns hundreds of properties across the country and lifts a freeze on construction work that had been in place pending the court's ruling.

In its decision, the court also deemed as unconstitutional the exclusion of lofts, rooftops, and swimming pool areas from building coefficients when calculating permitted building size.
