ACL's Turcan: ACL organisations are asking Ombudsman to challenge immediately Ordinance 49/2014
All the national organisations of the Christian Liberal Alliance (ACL) of the National Liberal Party (PNL) and the Democratic Liberal Party (PDL) are asking the Ombudsman to notify the Constitutional Court of Romania immediately abut Government Emergency Ordinance (OUG) 49 /2014, after PDL did so on July 4.
'On July 31, the Ombudsman replied to us in a letter that his institution ?asked pre-university and university education specialists for their opinion on the opportuneness and necessity for the measures regulated under Government Emergency Ordinance 49/2014.' Nobody asked Mr Ombudsman Victor Ciorbea to conduct an analysis of opportuneness! The Ombudsman must analyse whether or not the ordinance violates the Constitution, and if it does to notify the Constitutional Court about this case!' ACL Deputy Chair Raluca Turcan says in a press release issued on Wednesday.
She argues that the Ombudsman 'should not conduct propaganda or canvassing.'
'Opportuneness can be only for the Social Democratic Party (PSD) to win votes. The Ombudsman must see whether or not the approval of this ordinance by the PSD Government violated the Constitution and answer to the question: What was the emergency behind the emergency ordinance? In the area of education, there is no governing by emergency ordinance because there is no proving emergency in the area. In order to operate, the system needs legislative predictability and consistency. Romania's Constitution guarantees the right to education,' reads the release.
