Conflict of divorce laws

India's top court bans Islamic instant divorce

India's top court on Aug. 22 banned an Islamic practice that allows men to divorce their wives instantly, ending a long tradition that many Muslim women had fiercely opposed.

The Supreme Court ruled that the practice of "triple talaq", whereby Muslim men can divorce their wives by reciting the word talaq (divorce) three times, was both "unconstitutional and un-Islamic."

New bill aims to speed up divorce

Justice Minister Stavros Kontonis has put to public consultation a draft bill that will significantly speed up the process of uncontested divorce.

If the legislation is passed, couples that agree to dissolve their union will be able to settle any differences arising from issues such as separation of property, custody and child support, etc, with a simple notarial act.
